How the new law on Missouri can complete a criminal register in 2025


A criminal register can follow a person for years and create obstacles to employment, housing construction, education and financial opportunities. Which crimes cannot be extended?

While the new law is expanding the triggers, certain serious crimes do not remain promoted. The 2025 update adds four specific crimes to the list of crimes that cannot be triggered:

  1. Sexual behavior with a care facility based in the second degree
  2. Use of a child in sexual performance
  3. Promotion of a child’s sexual performance
  4. Cross Burning

In addition to previously inadmissible crimes, these are, including:

  • Most violent crimes
  • Any criminal offense that requires a registration of sex offenders
  • Crimes for domestic violence
  • Every crime with death
  • kidnapping
  • Crime of class A
  • Drive during the intoxicated (DWI) (with a separate trigger statute)
  • Driving with excessive blood alcohol content (BAC)

How the triggering process works

Despite the changes to the authorization and waiting times, the basic process remains the same:

  1. Enter a petition to the court in which the person was charged or found guilty
  2. The petition must contain all crimes that a person wants to trigger, and all companies that can have access to these records
  3. The Court of Justice notifies the prosecutor and other parties who may have records that have 30 days to submit an objection
  4. If there is an objection, a hearing is planned within 60 days
  5. If there is no objection, the judge checks the case and may need a hearing or not
  6. If the records are approved, the records are now sealed from the public perspective

The new law also requires that courts inform authorized persons about trigger opportunities if they complete their punishments and ensure that more people are aware of this option.
